Privacy Statement and Processing of Personal Data

Autodomus is committed to protecting the privacy of its customers when using its products and services, as well as when using its websites, and to developing technology that offers the best and safest online experiences.
Users are given the ability to browse most of the Autodomus websites without providing personal information. However, sometimes information is required to provide services requested by users and Customers.
This Privacy Statement helps you to understand how we collect, use and protect your personal data when you visit our websites and generally use our products and services.
By providing your personal data to Autodomus, you acknowledge and consent that it will be processed in accordance with this Statement of Privacy and Treatment of Personal Data and with the rules and principles contained in the respective terms and conditions of the services used. To this extent and with regard to the processing of personal data, the Customer must read this Privacy Statement together with the Terms and Conditions that regulate the offer of the various Autodomus products and services. If we intend to make any changes to this Statement, we will post those changes on this page so that you can consult the type of information we collect and how we use it.

DEFINITIONS

WHAT IS PERSONAL DATA?

Personal Data is any information, of whatever nature and whatever the support, including sound and image, concerning an identified or identifiable natural person (data subject). A person who can be identified directly or indirectly, in particular by reference to an identification number or to more specific elements of his/her physical, physiological, mental, economic, cultural or social identity is considered identifiable.

 

DATA COLLECTION

WHAT DATA IS COLLECTED AND GENERATED BY THE AUTODOMUS NETWORK OR SYSTEMS?

Normally, the personal data collected by Autodomus is limited to name, address, telephone number or e-mail address, but other data necessary for the provision of products or services may be collected.
Data inherent to the provision of services, such as traffic and location data, is also generated. These data are processed automatically, in compliance with the applicable legislation and the conditions defined by the National Commission for Data Protection ("CNPD").

 

WHEN IS PERSONAL DATA COLLECTED AND GENERATED?

In general, personal data is requested when the Customer subscribes to one of our products or services.
Autodomus respects your right to privacy and does not collect any personal information about you without your prior consent.
Some of the personal data is mandatory for the provision of the service. Autodomus will inform you of this obligation and if the required data is not supplied or is supplied incorrectly, Autodomus will not be able to provide the contracted service. The provision of incorrect or inaccurate data is your sole responsibility.

 

WHAT IS THE PURPOSE OF COLLECTING PERSONAL DATA?

As a general rule, the personal data collected from the Customers are intended for the provision and invoicing of the Services, the management and assessment of the contractual relationship with the Customer, the adaptation of the services to the Customer's needs and interests, the payment of the interconnection services, information, marketing or telemarketing activities of Autodomus, associated companies or companies in a dominating or group relationship with Autodomus and third parties, as well as the inclusion of the Customer in the subscriber lists.
Your personal data will also be processed to respond to your questions, suggestions or complaints.
In the event that the Customer fails to comply with the obligation to pay for the Service, Autodomus may enter the personal data of that Customer in the database created under Article 46 of Law No. 5/2004, of 10th February, unless the Customer has invoked an exception of non-compliance or has complained or contested the billing presented. The Customer will be notified of the inclusion of their data in this database within 5 days.

 

WHO IS RESPONSIBLE FOR THE PROCESSING OF THE PERSONAL DATA?

Modern Serenity, LDA (Autodomus) is responsible for the processing of personal data.

SUBCONTRACTORS, COMMUNICATION AND TRANSFER OF PERSONAL DATA

The personal data may also be made available to the courts and other competent authorities, in strict compliance with the law, in particular when they are necessary for the resolution of disputes regarding billing and for activities relating to the protection of public safety, defence and security of the State and the prevention, investigation or detection of criminal offences.

Autodomus may also use subcontractors for all or part of the purposes identified above, as well as for the maintenance, hosting and management of its computer systems and equipment, under the terms permitted by the legislation governing the processing of personal data, with these entities being obliged to keep confidential and ensure the security of the data of Autodomus Customers to which, for this purpose, they have access, and must not use these data for any other purposes or for their own benefit, nor link them to other data in their possession.

WHAT IS THE PERIOD FOR WHICH PERSONAL DATA IS KEPT?

Your personal data is only kept for the period of time necessary to provide the service or product, or to comply with Autodomus' legal obligations.

Traffic data may be retained up to the period during which the invoice may be legally challenged or payment claimed, or for the periods legally defined for the purposes of investigation and legal action of a criminal nature.

WHAT ARE COOKIES?

"Cookies" are small text files that are stored on your equipment (computer, tablet, mobile phone) via your internet browser ("browser") and are commonly used to retain information from your visit to the website between several sessions (e.g. preferences, pages visited, etc.).

WHAT TYPE OF COOKIES ARE USED ON THE AUTODOMUS WEBSITES?

- Strictly necessary cookies: they allow you to navigate on the site and use the applications and services that Autodomus makes available, such as accessing secure areas of the site - My Account, Online Store, among others. Without these cookies the services cannot be provided.

SPECIAL CASES

Calling and connected line identification

In accordance with the legislation in force, calling and connected line identification is offered.

The possibility of preventing the presentation of the calling line identification is guaranteed. Likewise, the called Customer is guaranteed the possibility to reject, through a simple means, incoming unidentified calls.

When connected line identification is provided, the called Customer is guaranteed the possibility to prevent, via a simple means and free of charge, the presentation of his line identification.

The restriction of the presentation of the calling and connected line will not be offered in the text messaging service (SMS) nor in the multimedia messaging service (MMS).

Under the terms of the Law, Autodomus may override the elimination of the presentation of the calling line to Customers who wish to determine the origin of unidentified calls disturbing family peace or the intimacy of private life.

To activate any of these options, the Customer must contact Autodomus Customer Services.

 

Location-Based Services

The Customer's use of location-based services (relating to the network cell where their telephone is located), provided by Autodomus or third parties, implies consent to the processing of their location data, for the period of time necessary for the provision of such services. The data will only be communicated to third parties where necessary for the provision of the services.

Information about your approximate location may also be recorded and passed to organisations with legal powers to receive emergency calls for the purpose of responding to such calls.

 

MARKETING AND TELEMARKETING

Autodomus may use the following methods to inform the Customer of new products and services: Post or fax, insertion of the information on the relevant service invoice, telephone, e-mail, SMS, MMS or any other electronic communications service, unless the Customer has objected.

In the Proposed Contract for the Provision of Electronic Communications Services you may not consent to the processing of your personal data for Marketing or Telemarketing purposes.

CUSTOMER RIGHTS

Right of access, correction, opposition and elimination of personal data

Under the terms of the applicable legislation, the Customer is guaranteed the right to access data that directly concerns him/her, and may request its correction or addition, by contacting the Autodomus Customer Support Service.

The Customer may also, at any time, oppose the processing of data, except for that strictly necessary to provide the service, and/or request elimination of their data for marketing or telemarketing purposes or inclusion in lists of subscribers and informative services by contacting Modern Serenity, LDA (Autodomus). in writing or via the email address: geral@auto-domus.com.

Security of personal data

Ensuring the confidentiality and security of customer data is a permanent concern of Autodomus. Because it recognises the sensitivity of this information, Autodomus has drawn up and disclosed to all its employees Privacy and Data Security Policies.

Autodomus has also appointed a Privacy Officer to monitor compliance with these policies and has defined clear rules for contracting the processing of personal data with subcontractors.

To ensure the permanent awareness of its employees and service providers about the rules applicable to data protection, Autodomus periodically develops training sessions for these people, having, likewise, prepared and disseminated a manual on the rules applicable to professional secrecy.

Autodomus employees and service providers also undertake not to reveal to third parties or use for purposes contrary to the law any personal information about Autodomus customers that comes to their knowledge in the course of their work.

Autodomus also has systems and teams in place to guarantee the security of information, creating and updating procedures to prevent unauthorised access, accidental loss and/or destruction of personal data.

Autodomus undertakes to respect the legislation on the protection of the privacy of Customer data and to process this data only for the purposes for which they were collected, as well as to ensure that these data are processed with adequate levels of security and confidentiality, under the terms of the applicable legislation and the conditions established by the CNPD.

In order to guarantee the security of its services and network, Autodomus reserves the right to monitor the performance and quality of the service and network in order to detect any technical faults, transmission errors, threats, unsolicited mail, viruses, hacking and other security vulnerabilities, but does not exercise, through human means, any control over the content of the information transmitted through its network.

Notwithstanding the fact that Autodomus has implemented security measures for the reception of data over the internet, we warn that the data circulating on the internet is not totally protected against eventual deviations, and the communication of access passwords, confidential codes and any other sensitive information is carried out under the entire responsibility of the Customer.

During the usage session of our websites, cookies are used that expire when the browser is closed. The use of cookies facilitates the transmission of communication and the provision of the service you have requested from us. Most browsers allow the Customer to choose whether or not to accept cookies, so that, if he so wishes, he may refuse them.

For your safety, when you access the Autodomus/My Account websites, the options and operations carried out are logged.

For your protection, access to some Autodomus services is protected by a password or access code. These codes will be sent by Autodomus to your phone and must not be passed on to third parties. For security reasons, we recommend that you memorise your password and change it regularly.
